TERMS OF SERVICE

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence, or that you are the age of majority and have given us your consent to allow your minor dependents to use this site on devices you own, purchase, or manage.

To use the Services, including browsing our store or purchasing products, you may be required to provide certain information such as your name, email address, billing, payment, and shipping details. You agree that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account and for all activity under your account. You may not transfer or sell your account to any other person.

SECTION 2 – OUR PRODUCTS

We make every effort to display our products as accurately as possible. However, colours and images may vary depending on your device settings.

Because many of our products are handmade, slight variations in colour, texture, size, and appearance are normal and are not considered defects.

All products are for external use only. Customers are responsible for reviewing ingredient lists and performing a patch test before full use. Discontinue use if irritation occurs. Softly Sharde is not responsible for allergic reactions or misuse of products.

All product descriptions and prices are subject to change at any time without notice. We reserve the right to discontinue any product at any time and to limit quantities.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. Your order is not accepted until it has been processed and confirmed by us.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud or unauthorized activity.

Once an order has been placed, we may not be able to accommodate cancellations.

Returns and exchanges are governed by our Refund Policy.

All purchases are for personal use only and not for resale.

SECTION 4 – PRICES AND BILLING

All prices are listed in Canadian Dollars (CAD) unless otherwise stated.

Prices do not include applicable taxes, shipping costs, customs duties, or import fees.

For U.S. and international orders, customers are responsible for any customs duties, import taxes, brokerage fees, or additional charges required by their country.

You agree to provide current and accurate payment and account information and authorize us to charge your selected payment method.

SECTION 5 – SHIPPING AND DELIVERY

We ship using third-party carriers including:

  • Canada Post

  • UPS

  • Purolator

  • DHL

Delivery times are estimates only and are not guaranteed.

Once an order has been transferred to the carrier, title and risk of loss pass to you, subject to your rights under applicable consumer protection laws.

We are not responsible for delays caused by shipping carriers, customs processing, weather conditions, or events beyond our control.

SECTION 6 – INTELLECTUAL PROPERTY

All content on this site — including text, images, logos, branding, product names, graphics, and design — is the property of Softly Sharde and is protected by applicable Canadian and international intellectual property laws.

You may not reproduce, copy, sell, or exploit any portion of the site without written permission.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” without warranties or liability.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party websites or their content, policies, or transactions.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify. All purchases are made directly with Softly Sharde, not Shopify.

SECTION 10 – PRIVACY

Your submission of personal information is governed by our Privacy Policy.

SECTION 11 – FEEDBACK

If you submit reviews, suggestions, or other content, you grant us the right to use them for marketing and business purposes without compensation.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions and to cancel orders if necessary.

SECTION 13 – PROHIBITED USES

You may not use the site for unlawful, fraudulent, abusive, or harmful activities, or to violate any laws or intellectual property rights.

Softly Sharde shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Services or products, to the fullest extent permitted by law.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Softly Sharde and Shopify from any claims arising from your breach of these Terms.

SECTION 18 – SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in effect.

SECTION 19 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Softly Sharde.

SECTION 20 – ASSIGNMENT

You may not transfer your rights under these Terms. We may assign ours without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

SECTION 22 – CHANGES TO TERMS

We may update these Terms at any time. Continued use of the site constitutes acceptance of any changes.
